Abstract

With a tumultuous history from colonization to socialist political regime, Vietnam is a fertile ground for legal transplant. The existence of continuous legal transplantation proves the transplantability of this country. The literature is debating on the criteria to assess the success of legal transplant. The paper based on dominant legal transplant theory to analyse the criminal liability of legal person in Vietnam as a case of reluctant transplant with traits of a failed transplant.
